Recently, an interview with a neighbor of the rental housing of "Aunt Mei" has once again pushed this long-standing child trafficking case back into the public eye. The neighbor described her as having "a thin oval face, and she does not look like the photos circulating online," a detail that quickly sparked widespread discussion on the internet. As a lawyer who has long focused on criminal defense and the protection of the rights and interests of women and children, I believe that although public discussion of "Aunt Mei's" appearance can indeed help solicit clues, what deserves more attention is: how is the statute of limitations calculated for the crime of child trafficking? What legal risks may the public face when reporting clues? And how can families of trafficked children protect their rights through legal channels?

I. The Statute of Limitations for the Crime of Child Trafficking: 20 Years Is Not an Absolute "Get Out of Jail Free Card"

According to Article 87 of the Criminal Law, if the maximum statutory penalty is death, the limitation period for prosecution is twenty years. The basic penalty for the crime of child trafficking is fixed-term imprisonment of not less than five years but not more than ten years, and in especially serious circumstances, it may be fixed-term imprisonment of not less than ten years, life imprisonment, or even death. If "Aunt Mei" is suspected of trafficking multiple children and causing especially serious consequences, the maximum statutory penalty may reach death, and the limitation period for prosecution is twenty years.

But twenty years is not an ironclad limit. Article 88 of the Criminal Law explicitly provides that if, after a people's procuratorate, public security organ, or state security organ has opened an investigation, or a people's court has accepted a case, a person evades investigation or trial, the statute of limitations for prosecution does not apply. This means that as long as the police opened an investigation into "Meiyi" back then and she has been on the run since, the statute of limitations simply does not apply. In practice, in 2016 the Guangzhou Zengcheng police opened an investigation into "Meiyi" on suspicion of child trafficking, so even though more than twenty years have passed since the crime, as long as she is brought to justice she can still be prosecuted in accordance with the law.

In addition, if a victim files a complaint within the limitation period and the judicial authorities should have filed a case but failed to do so, the limitation period also does not apply. A neighbor's statement that "the person does not look like the online photo" constitutes witness testimony. Under Article 50 of the Criminal Procedure Law, witness testimony is one of the statutory types of evidence, but it must be verified as true before it can serve as the basis for a verdict. A witness's memory may fade over time, and an online portrait itself is not statutory evidence but merely a simulated reference. Therefore, the neighbor's identification opinion can only serve as a lead and cannot independently be used as the basis for determining the identity of "Aunt Mei."

It is worth noting that some netizens, based on neighbors' descriptions, conduct "doxxing" and publicly identify certain individuals with similar appearances, which may constitute defamation. Article 1024 of the Civil Code stipulates that no organization or individual may infringe upon another person's right to reputation by means of insult, slander, or other such methods. If photos of innocent people are circulated alongside those of "Meiyi," causing a decline in their social evaluation, the perpetrator shall bear civil liability such as ceasing the infringement, apologizing, and compensating for losses. If the circumstances are serious, it may also constitute the crimes of insult or defamation under Article 246 of the Criminal Law.

Lawyer's advice: The public should report clues through proper channels to public security authorities, rather than posting unverified identification information on social media platforms without authorization. The spread of online profiles should also be handled with caution to avoid causing harm to people with similar appearances.

III. Rights Protection Pathways for Families of Trafficked Persons: Criminal Incidental Civil Actions and Compensation for Mental Distress

For families of abducted children, the law provides multiple avenues of relief. In criminal cases, victims may file an incidental civil action to seek compensation from the defendant for material losses caused by the trafficking, such as transportation and lost wages incurred in searching for their relatives. However, under Article 175 of the Interpretation of the Supreme People's Court on the Application of the Criminal Procedure Law of the People's Republic of China, incidental civil actions generally do not accept claims for emotional distress damages.

However, if a separate civil lawsuit is filed, according to Article 1183 of the Civil Code, where infringement upon a natural person's personal rights and interests causes serious mental distress, the infringed party has the right to request compensation for mental distress. In judicial practice, there have already been cases in which families of abducted persons, after a criminal judgment, filed separate lawsuits and were awarded emotional distress compensation. For example, in 2021, a provincial high people's court in a similar case ordered the defendant to pay tens of thousands of yuan in emotional distress compensation to the family of an abducted person.

Additionally, once abducted children reach adulthood, do they bear the obligation to support their adoptive parents? According to Article 1111 of the Civil Code, the rights and obligations between adoptive children and adoptive parents arise from the establishment of the adoptive relationship. However, if the adoption itself is illegal (such as buying an abducted child), the adoptive relationship may be deemed invalid, and the obligation to provide support is consequently extinguished. Abducted children have the right to choose to return to their original families and to pursue the criminal liability of the buyer in accordance with the law.

IV. Buying Abducted Children: The Legal Red Line for the Buyer's Market

"No buying and selling, no trafficking." Article 241 of the Criminal Law stipulates that whoever buys an abducted child shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, or surveillance. If, after the purchase, the person also commits such acts as unlawful detention or injury, the penalties for multiple crimes shall be combined. In 2015, Amendment (IX) to the Criminal Law further tightened the provisions: whoever buys an abducted child and does not abuse the purchased child or obstruct efforts to rescue the child may be given a lighter punishment; however, if the person does not obstruct the child's return to his or her original place of residence in accordance with the purchased child's wishes, the person may be given a lighter or mitigated punishment. This means that "buying is itself a crime," and there are no longer any "exemption clauses."

In practice, some buyers evade punishment under the guise of "adoption." Lawyers point out that lawful adoption must be registered with the civil affairs department, and the adopter must meet the conditions stipulated in Article 1098 of the Civil Code. A private transaction involving a child, whether or not money is paid, is suspected of the crime of buying an abducted child. If a family whose child was abducted discovers clues about the buyer while searching for their child, they should promptly report them to the public security organ, and may, through a lawyer, file a criminal incidental civil action or a separate civil action to demand compensation for the losses incurred in searching for their child and for emotional distress.

The "Aunt Mei" case spans over twenty years and has affected countless families. The law will not give up pursuing crimes just because time has passed, but when the public follows the case, they should also respect legal boundaries: do not spread unverified portraits, do not identify others without authorization, and do not interfere with investigations.
