Common Lease Contract Disputes and Avoidance Strategies
Lease contracts are among the most common civil contracts in daily life, covering residential leases, commercial leases, and factory leases.
Rent adjustment and payment are high-risk areas for disputes. It is advisable to clearly specify in the contract the payment method, payment timing, and the penalty standards for late payment. For long-term leases, a rent adjustment mechanism may be agreed upon, such as adjusting every two years based on the CPI or market rental levels.
The property repair responsibility clause is another area prone to disputes. The lessor should bear the maintenance obligations for the main structure and common facilities.
The liability for breach of contract upon early termination should be reasonably stipulated. If the liquidated damages are excessively high, the court may, upon the application of the parties, make adjustments, typically using the standard that the liquidated damages should not exceed 30% of the losses incurred. It is advisable to establish a reasonable notice period and compensation mechanism for early termination in the contract.
