Accused of Aiding Prostitution, Defense Secured Reduced Sentence
Defendants Deng XX and Liang XX were indicted by the Futian District People's Court in March 2012 for assisting in organizing prostitution, and a public prosecution was initiated. Attorney Wang Tengfeng, Director of Guangdong Zhiming Law Firm, along with attorneys Cao Guanghui and Zhang Qingping, were entrusted by their families to serve as defense counsel for Deng XX and Liang XX, appearing in court to defend them.
After accepting the commission, the defense counsel conducted thorough work, including meeting with the defendants and reviewing case files, to fully understand the true circumstances of the case. They keenly identified that the existence of the crime of organizing prostitution had not yet been verified, making the charge of assisting in organizing prostitution even more unfounded. During the court investigation, the defense counsel confidently argued against the prosecution's charge of assisting in organizing prostitution, pointing out that the defendants' actions did not meet the elements of the crime, and unequivocally presented a defense of innocence. In May 2012, the Futian District People's Court issued a first-instance verdict, completely overturning the prosecution's charge of assisting in organizing prostitution. Although the final judgment found the defendants guilty of harboring or introducing prostitution, it essentially adopted the defense counsel's argument for innocence regarding the original charge, resulting in a sentence of only 7-9 months of criminal detention.
