Zhiming Lawyer Defends Complex and Severe Illegal Fundraising Case: Our Client and All Defendants Received Substantial Sentence Reductions
Recently, the first-instance verdict was announced in a major collective crime case involving nearly twenty defendants, including He Musong, charged with illegally absorbing public deposits. The case was defended by a team of lawyers from Zhiming Law Firm, entrusted by the clients. The court fully adopted the defense arguments put forward by our lawyers. Our client, Xiao Mou, who was originally charged by the prosecution as a defendant in the second tier, was significantly downgraded in status, and his sentence was greatly reduced. It is worth noting that the sentencing of other co-defendants in the same case, whose crimes were similar to Xiao Mou's, was also reduced overall.
[3] Defendant Xiao Mou joined Shenzhen Huimou Group Company, founded by He Mousong in 2014, as a technical staff member responsible for software development. The prosecution and first-instance court determined that from 2014 to 2016, the company violated national financial regulations by illegally absorbing large sums of public deposits through online and offline channels, including the internet and mobile apps, luring victims with high interest rates. Due to the large number of individuals involved and the complexity of the case, both the public security and prosecution authorities deemed all suspects' circumstances severe and the amounts involved substantial, warranting heavy sentences under the law.
[4] Upon taking the case, Zhiming lawyers efficiently and swiftly completed document review and client meetings. Amidst the voluminous and complex evidence, they firmly focused on the key core of our client Xiao Mou's role in the joint crime, centering the defense around this point. In light of the factual evidence and the law, the first-instance court fully considered and ultimately adopted our defense arguments. Following court hearings and deliberation by the adjudication committee, our client Xiao Mou was sentenced at the lightest statutory penalty level. Moreover, through our lawyers' strong persuasive arguments during the trial, other defendants in the case with similar circumstances also received lighter sentences.
