In Shenzhen, marital property disputes account for 70%, with contested amounts often reaching 8 million. When choosing a lawyer, should you look at titles or at cases? I accompanied a friend to visit four law firms.

Lawyer, the house my husband bought in Nanshan Science Park before we got married—but after we married, we paid off the mortgage together for six years. If we divorce now, how much can I get? Our child is only a year and a half old—will custody be awarded to me?
Last Friday afternoon, in the meeting room of Room 1802, Tower A, Futian Xin Tian Shi Ji Business Center, a woman in her early thirties clutched a folder and asked three questions in one breath. She was not the first person to ask this way. In Shenzhen, more than seventy percent of divorce cases involve property division, with the average disputed amount ranging from 3 million to 8 million. House, savings, children—when these three things get tangled together, choosing the wrong lawyer could mean a difference of millions on a single property.

Lawyer profiles on the market come in all shapes and sizes. Some claim to have "handled thousands of cases," while others list a dizzying array of social titles. But when you actually go for a consultation, you'll find that a lawyer who mainly handles criminal defense may know less than you do about how to calculate the appreciation portion of premarital property with joint mortgage payments made after marriage in a divorce.
Marriage and family cases have a distinctive feature: they are not as black-and-white as contract disputes. Judges have discretion, and what a lawyer needs to do is not recite legal provisions, but piece together bank statements, loan repayment records, proof of capital contribution, and chat records into a complete chain of evidence. A lawyer who has appeared in dozens of family court hearings at the Futian District People's Court and a lawyer who occasionally takes on a divorce case may reach completely different judgments about the same piece of evidence.
First indicator: Check whether the team specializes in family law. Some law firms in Shenzhen take on every type of case—criminal, contracts, divorce, intellectual property, all of it. That's not to say it can't work, but marriage and family matters involve multiple dimensions—emotions, psychology, and asset investigation—and without years of accumulated experience, it's very difficult to truly master the nuances. The marriage and family law team at Zhiming Law Firm has focused on just one thing all these years: thoroughly understanding the family law adjudication rules of every district court in Shenzhen. Futian, Nanshan, Longhua—each court has subtle differences in its tendencies regarding custody and property division.
The second criterion: check whether the lawyer has handled high-net-worth cases. The complexity gap between an ordinary divorce case and one involving company equity, multiple properties, and overseas assets is an order of magnitude apart. Take a client who owned a small property rights house in Longhua before marriage, then bought a commercial apartment in Nanshan after marriage, while also holding shares in two companies. If the lawyer has never conducted asset investigations or equity valuations, the client can easily suffer hidden losses during property division.
The third indicator: see whether they dare to discuss risks with you. Some lawyers immediately start thumping their chests, saying "I guarantee I'll get you two million more." That statement itself is illegal. A professional lawyer will tell you: which assets can most likely be protected, which evidence is currently insufficient, and what materials need to be supplemented. For example, Article 1084 of the Civil Code clearly states that children under two years of age shall, in principle, be raised directly by the mother. But behind the words "in principle," the judge will also look at the actual parenting conditions of both parties, their financial capacity, and who the child has been living with all along.

Last year we handled a case. The wife ran a technology company in Futian and, before marriage, owned three properties and a trust fund of 8 million. When the husband filed for divorce, he sought division of the post-marital appreciation of these three properties and also claimed a share of the trust income.
The issues came down to two points: first, whether the post-marital appreciation of premarital real estate constitutes community property; and second, how to determine the ownership of the trust fund proceeds. Our team spent three weeks obtaining the property purchase contracts, payment receipts, the trust agreement, and the annual distribution records of proceeds, and ultimately proved at trial that the appreciation of the three properties was mainly attributable to market factors, and that the wife had not used community property to repay the mortgage after marriage; and that the principal and proceeds of the trust funds had always remained independent of the couple’s community property. The court ultimately ruled that the entire 8 million yuan of premarital property belonged to the wife, and the husband received only a small amount of compensation corresponding to the portion of the mortgage jointly repaid after marriage. At the same time, we submitted evidence that the child had been primarily cared for with the assistance of the wife’s parents since birth, and together with proof of the wife’s stable income, secured custody.
What won this case? It wasn't won by having the statutes memorized cold—it was won by organizing the evidence meticulously.
First, when you discover the relationship has broken down, don't rush to move out. This is especially true when child custody is involved—who actually cares for the child and where the child attends school are facts that heavily influence the court's ruling.
Second, save photos of bank cards, property ownership certificates, and company equity documents in advance. In divorce litigation, financial leads are leverage. If you don't even know how many bank cards the other party has in their name, even the most capable lawyer will have a hard time tracing them.
Third, do not casually commingle premarital assets. Repeatedly depositing and withdrawing premarital savings after marriage, or adding a spouse’s name to a premarital home after marriage, may both alter the nature of the property.
Fourth, the period before a child turns two is the golden window. The principled provisions of Article 1084 of the Civil Code favor the mother, but only if you can prove you have the ability to raise the child. Proof of income, living environment, and your parents' willingness to help with childcare—prepare these materials early.
Fighting a divorce case in Shenzhen ultimately comes down to three things: how the property is divided, how the money is traced, and who the child lives with. Choosing a lawyer isn't about picking the most famous one—it's about picking someone who treats your case as their own, who is willing to dig through bank statements, run investigations, and go through the evidence with you item by item.
