An Old House in Shenzhen Sparks a Property Dispute Between Siblings: The Will Is Contested—How Should the 20 Million Yuan Estate Be Divided? A Lawyer Breaks Down Three Key Determinations

Late last year, a client working in Nanshan Science and Technology Park came to us. His father owned an old house in Futian, with a market value of just over 20 million yuan. Before the old man passed away, he wrote a will by hand, stating that the house was to be left to his youngest son. As soon as the old man passed, however, the three older sisters raised objections — the will was indeed written by their father, but he was already 78 years old at the time, his handwriting was crooked and shaky, and only one neighbor was present as a witness. The sisters believed the will was invalid and demanded that the estate be divided equally among the four siblings under statutory inheritance.

Similar inquiries have been coming to Zhiming Law Firm more and more frequently over the past two years. Inheritance dispute cases in Shenzhen have been growing at about 15% annually, with a notably rising share involving cross-border and cross-generational inheritance. Many families get stuck on the same questions: Does the will actually hold up? Should the house be divided? Today, drawing on cases we have handled, we will break this down clearly.

First, let's clarify: an invalid will and a disputed will are two different things.

Many people immediately ask, "Is this will valid?" In fact, the legal judgment involves two levels. First, formal requirements; second, substantive requirements.

What formal requirements should be examined? Articles 1134 to 1139 of the Civil Code set out clear provisions for different forms of wills. A holographic will must be written, signed, and dated in the testator's own hand; a will written on behalf of the testator must have two or more witnesses, one of whom writes it on the testator's behalf, with all parties signing. The handwritten will just mentioned, if it was indeed written in the elderly person's own hand, would hold up formally even if the handwriting is messy. But there was only one neighbor as a witness—if it is determined to be a will written on behalf of the testator, the number of witnesses would be insufficient.

What do the substantive elements involve? Whether the elderly person had full civil capacity when making the will, and whether they were coerced or deceived. This point is especially prone to dispute in elderly individuals over the age of 75. According to 2024 statistics from the Shenzhen Intermediate People's Court, in inheritance disputes involving challenges to the validity of a will, more than 60% of cases raise the issue of "whether the elderly person was of clear mind at the time."

2. Three Inheritance Paths That Could Make a Difference of One House

Simply put, there are basically three paths for how the property left behind by parents gets divided.

Path One: Valid testamentary succession. The will is valid and shall be executed according to its terms. Regarding the client in Nanshan mentioned earlier, we ultimately secured the full inheritance rights to the real estate for him. The key was that through handwriting authentication, testimony from neighbor witnesses, and the elderly person’s medical records before and after making the will, we formed a complete chain of evidence proving that the elderly person was of sound mind when making the will and that the will was written in his own hand.

Path Two: Statutory succession. If the will is invalid or there is no will, inheritance shall proceed according to the statutory order under Article 1127 of the Civil Code. The first order consists of the spouse, children, and parents. Distribution is generally equal, but those who have fulfilled the primary duty of support may receive a larger share.

Path Three: Negotiated Division. The parties do not dispute the validity of the will and go straight to discussing how to divide the estate. Many families in Shenzhen choose discounted compensation—one person takes the property and pays the others in cash. This approach saves time, but it presupposes that everyone agrees on the value of the property.

III. Cross-Border, Cross-Generational Inheritance: Shenzhen’s Unique Challenges

Inheritance cases in Shenzhen have a notable characteristic: a high incidence of cross-border elements. For example, one parent may be a Hong Kong resident, the property may be located in Futian or Luohu, Shenzhen, and the children may be scattered overseas. In such circumstances, determining which jurisdiction's laws apply, how to prove kinship, and how to notarize and authenticate overseas documents—each of these steps can cause delays of several months.

Another scenario involves generational inheritance. When an elderly person passes away, if some of their children have already died, can the grandchildren inherit by subrogation? Article 1128 of the Civil Code stipulates that if a child of the decedent predeceases the decedent, the direct descendants of that child shall inherit by subrogation. However, in practice, proving the timing of the "predecease" and the chain of kinship often requires retrieving household registration archives from decades ago.

Four, why such cases particularly test a lawyer's "evidence organization skills"

Inheritance disputes are different from ordinary contract disputes. Contract disputes focus on the contract, while inheritance disputes focus on "people" and "time." Behind a will, there may be years of medical records of the testator, memory biases of multiple witnesses, and complex emotional relationships within the family.

Zhiming Law Firm has handled a large number of cases in 26 years, and Chief Lawyer Shen Jinlong has a unique background in the field of inheritance disputes - a master's degree and economist from Fudan University, and worked as an executive in a state-owned enterprise in his early years. A direct advantage brought by this experience is that lawyers with a pure legal background are often more sensitive in judging the value of real estate and understanding the structure of family property. In inheritance cases, a 10% difference in property valuation could result in a difference of several hundred thousand yuan per person.

Internally, we summarize this approach to handling cases as the "Zhiming Art of Litigation" system, which has received dual innovation awards from both the provincial and municipal bar associations. Put simply, it means: rather than mechanically applying legal provisions, we first clarify family relationships, the chain of assets, and evidentiary gaps, and only then decide on litigation strategy.

V. A Real Case of 20 Million Property Inheritance

Back to the case at the beginning. The three sisters hired a lawyer, arguing that the will was invalid and that the estate should be divided equally according to statutory inheritance. We represented the youngest son, and did several things:

First, obtain all outpatient and inpatient records from the three months before the elderly person made the will, to prove that although advanced in age, the person had normal cognitive function and no illness affecting civil capacity. Second, locate the neighbors who were present at the time, secure witness testimony, and apply for handwriting authentication. Third, trace the elderly person's life in their later years to prove that the youngest son had lived with the elderly person for a long time and fulfilled the primary support obligation.

In the end, the court ruled that the will was valid, and the youngest son was granted full inheritance rights to the property. The case took about 11 months from filing to judgment. If the will had been deemed invalid and the estate divided equally among the four, he might have received only around 5 million—a difference of 15 million.

6. Four Practical Suggestions for Shenzhen Families

First, when an elderly person makes a will, it is best to go to a notary office or have a lawyer witness it. Although a holographic will is low in cost, once a dispute arises, the cost of proof is extremely high. Second, keep the elderly person’s medical records, daily photos, and videos in good order, because these become evidence when a dispute arises. Third, assess the property value in advance. In Shenzhen, homes in different districts and of different building ages may differ by more than 20% in appraised value. Fourth, if brothers and sisters have already begun to have disagreements, consult a professional lawyer as early as possible; do not wait until the other side has prepared all the evidence before taking action.

In inheritance disputes, what is at stake is not just money, but also a sense of justice. Yet the law only looks at evidence. In Shenzhen's Futian, Nanshan, and Longhua districts, an ordinary home easily costs several million to over ten million yuan. Making proper legal arrangements in advance is far more cost-effective than fighting a two-year lawsuit after the fact.
