Nairuier consumer fraud, Zhiming lawyers represent rights protection
At the beginning of 2009, consumer Zhang used a body shaping experience voucher given by an underwear store from Nairier Company to try their service. During the experience, Nairier staff told Zhang that she had many granules and lumps in her chest, and brought in the store manager for a re-examination. The manager then diagnosed that "the plaintiff has very serious fibroids in her chest" and told Zhang that she must open a membership card at Nairier for care, and that only through Nairier's products, equipment, and staff techniques could the fibroids be eliminated. Believing she was "sick" and trusting Nairier's promise to cure her, Zhang opened a membership card at Nairier to "treat the illness."
After spending over 100,000 yuan on "treatment" at Nairier for more than a year without seeing results, Zhang raised doubts. Nairier staff told her that the treatments over the past year had been relatively "low-end" products with slower effects, and suggested she switch to "mid-to-high-end" products. When Zhang said she no longer wanted to continue due to lack of results, Nairier staff warned that stopping the "treatment" would undo all progress, and that if her chest developed cancer, she would have to bear severe consequences like mastectomy. Fearing such outcomes, Zhang followed Nairier's arrangements and opened several "high-end" product treatments. By December 2011, feeling no improvement and instead experiencing persistent swelling and stabbing pain, Zhang heeded a friend's advice to seek medical examination. The diagnosis was: breast lumps, no surgery or treatment needed at present. By then, Zhang had accumulated 265,929 yuan in membership card charges at Nairier. During the three years of continuous "treatment," Zhang constantly worried about her "condition" worsening, enduring immense mental anguish.
Zhang approached our firm seeking rights protection. Our lawyers Wang Tengfeng and Yang Lirong, after reviewing the case, determined it to be a consumer fraud dispute. They accepted Zhang's commission in accordance with the law and filed a lawsuit with the Luohu District Court on February 13, 2012. The case has been accepted and is currently under trial.
