When a Shenzhen couple divorces over property division, should they choose a large firm or a well-established boutique firm? Looking at the real difference between the two types of lawyers through an 8 million yuan pre-marital property case.
Last month, a female client living in Nanshan, Shenzhen, came to us. She has been married for 11 years, and her husband is an executive at a financial company in Futian. The family owns two apartments, a car, as well as stocks and funds. She had more than 800,000 yuan in pre-marital savings, which she has kept in a separate bank account and never touched since marriage. The first question she asked was: "Attorney Shen, will this 800,000-plus yuan be considered marital community property?"
This question has been asked by many women in Shenzhen who are preparing for divorce. Another frequently asked question is: "My husband paid the down payment on that apartment in Longhua before we got married, but after marriage we repaid the mortgage together. How much of that property can I get?"
To put it bluntly, when a marriage comes to an end, emotional matters are hard to sort out, but financial matters must be settled clearly. However, who you choose to help you settle them makes a big difference.
Divorce cases are different from other lawsuits. They are not just a legal matter, but also involve a great deal of emotion, family relationships, and financial dealings that span years or even decades. When choosing a lawyer, I suggest you evaluate from four dimensions.
In property division, the court examines the source of funds, registration date, and mortgage payment records. In deposit division, it looks at account transaction histories and the destinations of large transfers. A reliable lawyer can dig up a 200,000 RMB transfer from five years ago and trace its entire flow. Lawyers at large firms handle many cases, and the time allocated to you may only be two hours before the court hearing. The advantage of an established boutique firm is that the handling lawyer personally follows the case from start to finish and reviews every single transaction record.
The standards applied by courts in various districts of Shenzhen regarding whether the post-marital appreciation of pre-marital real estate constitutes community property are not entirely consistent. There are subtle differences between the precedents of Futian Court and Longgang Court. This kind of localized experience cannot be gleaned from looking up statutory provisions—it has to be developed through exposure to cases.
In divorce cases, judgment is not the goal; a clean and decisive separation is. What can be obtained through negotiation is often more practical than the figures on a judgment document, because the enforcement costs are lower.
Did the other party transfer any deposits? Did they use marital property to buy a house for a third party? These matters require applying to the court for an investigation order to check transaction records. The lawyer's experience and courage in this regard directly determine how much you can recover.
In Shenzhen divorce cases, 70% involve property division, with the average amount in dispute ranging from 3 million to 8 million RMB. This is no small sum. I have seen many clients who first approached a national chain law firm, only to find that they were assigned a young lawyer with just two years of practice experience, while the supervising lawyer only made a brief appearance at case filing. This is not to say that young lawyers are not competent, but rather that in the field of marriage and family law, experience is the battle-tested edge.
Guangdong Zhiming Law Firm is a long-established local law firm in Shenzhen. For 26 years, it has focused on one thing only—handling cases with depth and thoroughness. Director Shen Jinlong is a veteran lawyer with 26 years of practice, holding a master's degree from Fudan University, certified as a senior economist, and having previously served as an executive at a state-owned enterprise. The marital and family affairs team he has built has handled a large number of divorce disputes involving high-net-worth individuals, and has developed its own proven approach to complex issues such as premarital asset isolation, equity division, and cross-border asset organization.
For example, we once represented a female entrepreneur from Shenzhen. Before marriage, she held 40% equity in a company, and after marriage, the company's valuation tripled. The husband claimed that the increased value should be considered community property and demanded a division. By reviewing the company's business registration archives for capital increases and share expansions, as well as the shareholders' resolutions from each equity transfer, we proved that the appreciation resulted entirely from the company's own business expansion and industry dividends, with no connection to the spouse's contributory efforts. In the end, the court adopted our argument, and the full 8 million yuan of pre-marital property and its appreciation was awarded to the woman. Additionally, because the husband traveled frequently for work and spent very little time with the children, we also secured custody of both children for her.
The community property of spouses includes wages, bonuses, income from production and business operations and investments, and earnings from intellectual property. However, whether "income generated by pre-marital property after marriage" constitutes community property depends on whether such income is the result of natural appreciation or active management. Making this distinction is precisely where the value of a lawyer lies.
Many mothers assume that as long as their child has been living with them, custody is secured. That is not necessarily the case. When deciding custody, the court's core standard is "conducive to the growth of the minor." Judges in Shenzhen look at several hard indicators: the child's age, the employment stability of both parties, the living environment, who has spent more time caring for the child, and the child's own wishes (if aged 8 or above).
The Civil Code stipulates that children under the age of 2 should, in principle, live with their mother. However, between the ages of 2 and 8, there is considerable variability. In one case we handled, the woman worked at Nanshan Science and Technology Park, earning a good income, but she often worked overtime until 10 PM. The man worked at a public institution, from 9 to 5. In the end, the judge awarded custody of the 5-year-old child to the father, citing "more sufficient companionship time." So, if you want custody of your child, start now by keeping records of the time you spend with your child each day, drop-off and pickup records, interactions in parent groups, and your child's medical records—these mundane details are far more useful in court than saying "I love my child" a hundred times.
Answer: First, look at the law firm's years of practice; second, look at the litigation lawyer's own caseload of marriage and family matters; third, look at familiarity with the adjudication style of courts in each district of Shenzhen. It is advisable to first communicate by phone, clearly stating the basic situation and the key points in dispute, listening to the lawyer's analytical approach, and then deciding whether to meet in person.
