Seventy percent of Shenzhen divorce cases involve disputes over real estate. If the other party keeps delaying the divorce, how should 8 million yuan in assets be divided? A Futian lawyer evaluates three resolution paths.

Last Wednesday afternoon, a woman who works as a product manager in Nanshan Science and Technology Park sat down in our conference room. Her first words were: "He has moved out, but he simply refuses to go to the Civil Affairs Bureau. He said he would drag it out even if it kills me." She held two properties, one in Hongshan, Longhua, and one in Shixia, Futian, with a combined market value approaching RMB 12 million, and she also had a daughter who had just started primary school. She asked three questions: If the other party does not agree, can the marriage be dissolved at all? How long will litigation take? How will the properties and the child ultimately be handled? These are in fact the three most typical sticking points in divorce disputes in Shenzhen. Shenzhen has approximately 50,000 divorce registrations each year; 70% of litigation cases involve property division, with average disputed amounts between RMB 3 million and RMB 8 million, and Futian, Nanshan, and Longhua are the main battlegrounds.

When affection has broken down and you want a divorce, but the other party will not cooperate, there are, put plainly, three paths: divorce by agreement, divorce by litigation, and negotiating while litigating. Divorce by agreement is fast, but it requires that the other party be willing to talk and that there be no major disagreement over property and custody; once the 30-day cooling-off period passes, you can get the certificate. The problem is that if the other party is determined to stall, this path is basically impassable. Divorce by litigation is the choice of most people, but many are frightened by the fact that a first suit is often not granted. In fact, Article 1079 of the Civil Code clearly provides that if the parties have lived apart for two full years because of incompatibility, or if one party has domestic violence, gambling, or other bad habits and refuses to correct them despite repeated admonition, the court shall grant divorce if mediation is ineffective. The key is not the legal provision, but whether you can turn the breakdown of affection into evidence the judge can see.

How long does a litigated divorce take? This is the question we are asked most often. A summary procedure generally takes 3 months, and an ordinary procedure 6 months, but if it involves real estate appraisal or the other party deliberately refuses to accept service of summons, some cases can drag on for a year and a half. In a case we handled in Futian, the parties fought fiercely over a property worth RMB 8 million and child custody, but it took only 3 months from filing to conclusion by mediation. The reason it was fast was not that the court was biased; it was that before filing, we had fully prepared the asset leads, custody evidence, and mediation plan. As soon as the judge saw that the materials were clear, mediation was arranged directly.

How do you fight over property? In divorce cases in Shenzhen, real estate is the main asset. For a house where one party made the down payment before marriage and the couple jointly repaid the mortgage after marriage, the compensation formula is: the jointly repaid mortgage portion ÷ 2, then multiplied by the property appreciation rate. It sounds simple, but in practice how the appreciation rate is calculated and how the source of the down payment funds is proven often determine a difference of hundreds of thousands or even over one million yuan. A client in Longhua had parents transfer 3 million yuan before marriage to pay the down payment, but the transfer memo stated loan; opposing counsel seized on this and demanded that the debt be repaid before dividing the property. We retrieved the chat records and family account books from that time, and in the end the court found that the money was a gift, treated the property as community property, and the client received nearly 900,000 yuan more.

On custody, the court looks at the best interests of the minor child. Children under two are, in principle, placed with the mother; for children over eight, the child’s wishes must be considered; for the age range in between, the court looks at who provides more actual care, a more stable living environment, and better educational resources. In the case of that product manager in Futian, the father earned more than she did, but we submitted records showing that she took the child to and from school every day, attended parent-teacher meetings, and tutored the child’s homework, as well as testimony from the schoolteacher. In the end, custody was awarded to her, and the father pays child support on a monthly basis.
