On the morning of March 24, Zhang Bin, a 36-year-old IT professional in Shenzhen, was found dead on the toilet in a hotel rented by his company. At 1 a.m. that day, he had sent his last work email.

Zhang Bin held a master's degree in computer science from Tsinghua University and worked at the Shenzhen branch of Wingtech Group Co., Ltd. (hereinafter referred to as Wingtech), where he was responsible for software development on a project. According to his wife, Ms. Yan, Zhang Bin often worked overtime until early morning, sometimes even until 5 or 6 a.m., and then continued working normally the next morning. Ms. Yan believes Zhang Bin's sudden death was related to prolonged continuous overtime, saying, "He exhausted himself to death for this project."

IT man's sudden death: Can labor law not regulate overtime?

The labor law stipulates that if an employer needs to extend working hours for special reasons, the extended working time per day shall not exceed three hours and per month shall not exceed 48 hours, provided that the health of the workers is ensured. However, Zhang Bin, who died suddenly, only rested for a few hours each day and had been working overtime for a long time, with his overtime hours clearly exceeding the legal limits. At Wentai Company, the labor law provisions regarding overtime work were not implemented. Whether or not continuous excessive overtime was the direct cause of Zhang Bin's sudden death, this phenomenon of disregarding legal regulations on overtime must be rectified.

Employers must change their employment philosophy, learn to make good use of talent, and seek long-term and stable contributions from workers, rather than blindly pursuing short-term gains and exploiting workers. Zhang Bin, a master's graduate from Tsinghua University, was a high-level talent with advanced skills, and the company should have valued and protected him. However, in reality, some enterprises ignore talent protection for short-term benefits, relentlessly exploiting workers, leading to many tragedies of illness and death due to overwork. From the perspective of long-term development and practical impact, such exploitation is detrimental to the enterprise, only causing talent to become disheartened and reducing work efficiency. Employers must recognize that the potential and value of talent need to be reasonably tapped, and rushing to impose excessive work pressure on workers will only backfire.

At the same time, it should be pointed out that workers' lack of self-protection and rights awareness is also a significant reason for the prevalence of excessive overtime. Faced with unreasonable overtime demands that harm their rights and health, many workers do not know how to protect themselves or assert their rights. Workers should understand that health is the prerequisite for good work; while work is valuable, health and life are the foundation of life. Workers should learn to safeguard their rights and bravely say no to excessive overtime.

Furthermore, since the labor law has long had provisions, why does excessive overtime still exist? Clearly, the law has not been implemented. Relevant authorities need to improve legislation and strengthen law enforcement to ensure that the law truly protects workers. For example, enhancing the binding and mandatory nature of legal provisions, issuing warnings and penalties to enterprises that allow excessive overtime, and guiding, dissuading, or even forcibly removing "workaholic" employees from their posts to further protect workers' personal rights.

In summary, to prevent similar tragedies from recurring, workers, employers, and relevant authorities must work together, as none of the three can be absent. Only when workers' self-protection and rights awareness are enhanced, employers' employment philosophies are elevated, and relevant laws and regulations are improved and implemented, can the phenomenon of overtime that disregards workers' rights and health be curbed, ultimately achieving a harmonious win-win situation for both workers and employers.
