Recently, the Zhejiang Provincial Public Security Department held a press conference to report on the successful cracking of the "2.23" major case involving the production and sale of counterfeit micro-plastic surgery drugs by police in Jiaxing and Haining. Twenty-one suspects were arrested, one illegal underground factory producing counterfeit drugs was dismantled, five illegal sales and storage warehouse sites were shut down, and over 130 types of counterfeit drugs and unregistered medical devices, including botulinum toxin, anesthetic cream, and hyaluronic acid injections, totaling approximately 270,000 boxes (vials), were seized, with the case involving over 300 million yuan.

Not long ago, there was the Shandong Changsheng Biological Vaccine case, and now there is this case of manufacturing and selling counterfeit micro-plastic surgery drugs involving 300 million yuan. These lawbreakers, driven by financial gain, have lost all conscience—it's simply absurd! Oh my god, these things are meant to be injected into the human body!
As trends constantly change, women's desire for beauty grows stronger, and the demand for medical cosmetic procedures is booming. The high profits and relatively low entry barriers of medical micro-plastic surgery have led some lawless individuals to illegally produce and sell cosmetic drugs and devices without proper qualifications, resulting in incidents that harm consumers' health.
How harmful are micro-plastic surgery procedures?
Micro-plastic surgery procedures are mainly performed by injecting drugs into the face. If substandard counterfeit drugs are injected into a patient's face, these inferior materials can cause skin suppuration, infection, and tissue erosion. This is a complication of injection-based cosmetic treatments, and these hazards could potentially lead to tumors.
Especially fake botulinum toxin, if the manufacturing process is not precise enough, its toxin content may be too high. Injecting one or two doses could lead to paralysis of the respiratory muscles, causing immediate suffocation or even death.
In China, the following provisions apply to the crime of producing and selling counterfeit drugs:
1.Article 141: Those who produce or sell counterfeit drugs
Shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention, and shall also be fined; if causing serious harm to human health or having other serious circumstances, they shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years, and shall also be fined; if causing death or having other especially serious circumstances, they shall be sentenced to fixed-term imprisonment of not less than ten years, life imprisonment, or death, and shall also be fined or have their property confiscated.
The term "counterfeit drugs" as used in this article refers to drugs and non-drugs that are classified as counterfeit drugs or treated as counterfeit drugs under the provisions of the Drug Administration Law of the People's Republic of China.
2.Definition of counterfeit drugs
The counterfeit drugs stipulated in the "Administrative Law of the People's Republic of China" include counterfeit drugs and drugs treated as counterfeit drugs. Article 48 of this Law stipulates: "The production (including preparation, the same below) and sale of counterfeit drugs are prohibited. The following circumstances constitute counterfeit drugs: (1) The ingredients contained in the drug do not conform to the ingredients specified in the national drug standards; (2) Non-drug substances are used to impersonate drugs, or one type of drug is used to impersonate another type of drug. The following circumstances are treated as counterfeit drugs: (1) Drugs prohibited by the drug regulatory department of the State Council; (2) Drugs produced or imported without approval as required by this Law, or sold without inspection as required by this Law; (3) Deteriorated drugs; (4) Contaminated drugs; (5) Drugs produced using raw materials that should have obtained approval numbers as required by this Law but have not; (6) Drugs whose indicated indications or functional indications exceed the specified scope."
3.The term "drug" in this crime only includes drugs for human use.
The production of veterinary drugs does not constitute this crime but may constitute the crime of producing and selling counterfeit and substandard products. Even if a drug cannot actually be used on the human body, when the perpetrator falsely represents it as a drug for human use, it is a counterfeit drug—using veterinary drugs for human use.
If a medical institution knowingly uses or sells counterfeit drugs, it shall be investigated for criminal liability for the crime of selling counterfeit drugs.
