Lawyers from Zhiming Law Firm Successfully Secure Refund of Home Purchase Deposit for Client
In August 2011, Miss Wang learned through advertisements that a certain property in Bao'an was about to be pre-sold. She visited the sales office to inquire about the property and was warmly received by a saleswoman. After viewing the specific layout of a floor, she paid a housing deposit of 150,000 yuan that same day. Later, after a second on-site inspection and further inquiries, she felt the property did not meet her requirements and decided to cancel the purchase and request a refund of the deposit. When Miss Wang informed the saleswoman of her intention, she was met with a cold refusal. Seeking legal help, she consulted several lawyers but was told that recovering the deposit was hopeless. Eventually, through a friend's introduction, she found Wang Tengfeng, the director of Zhiming Law Firm.
After reviewing the subscription agreement and understanding the property details, Lawyer Wang Tengfeng believed Miss Wang had a chance of winning the case. The subscription agreement clearly stated that the sales office was obligated to provide and explain the formal real estate sales contract text and supplementary agreements, the land use rights transfer contract and its supplements, the "Real Estate Pre-sale Permit," the "Construction Land Planning Permit," the "Construction Project Planning Permit," and the "Construction Permit" to the buyer for review. However, the subscription agreement was signed before the property's pre-sale date, and these documents were not displayed at the sales office, nor were they provided to Miss Wang for review or explanation, constituting suspected fraud.
After taking on the case, under the guidance of Director Wang Tengfeng, a legal team consisting of lawyer Yang Lirong and trainee lawyers Chen Qingxu and Ren Guo from Zhiming Law Firm engaged in difficult negotiations with the sales office and property developer's management. They explained the adverse consequences for the sales office and developer if Miss Wang filed a lawsuit, eventually reaching a mediation agreement: the full refund of Miss Wang's 150,000 yuan deposit! The case was resolved smoothly according to the planned approach, avoiding a time-consuming and labor-intensive litigation process.
