One day in late November 2009, the client Chen Hongxiu, upon a friend's introduction, sought out Guangdong Zhiming Law Firm by reputation.LawyersAccording to the client's initial account of the case, it turned out that her daughter, Chen Wei, was admitted to Shenzhen Henggang People's Hospital on October 25, 2009, due to physical discomfort. After examination, she was diagnosed with an ectopic pregnancy. After 12 days of hospitalization at Henggang People's Hospital, her condition deteriorated and she was transferred to Peking University Shenzhen Hospital. Following the transfer, Chen Wei's condition did not improve but continued to worsen, and she passed away on November 12, 2009. After taking on the case,LawyersAttorney Cao Guanghui, the lead counsel, and his assistant, Attorney Zhang Qingping, organized multiple case discussions and concluded that the case was complex, with the involvement of medical knowledge further adding to its difficulty. Through these deliberations, two strategies were devised for the case: first, to pursue a negotiated settlement, and second, to file a lawsuit with the court. With full respect for the parties' opinions, Attorney Cao and his assistant, Attorney Zhang Qingping, repeatedly negotiated with the legal representatives of Shenzhen Henggang People's Hospital in hopes of resolving the case through mediation. Initially, however, the hospital took a tough stance, insisting that it would not mediate until the Medical Association and the court had determined whether it was at fault, the extent of its fault, whether compensation was due, and the amount thereof. When early mediation efforts failed, the case was filed with the court on February 14, 2010. During the process of submitting the unsealed medical records, Attorney Cao meticulously noticed that one admission notice from Shenzhen Henggang People's Hospital was missing from the sealed records, leading him to suspect that the hospital had tampered with the medical records. He repeatedly and strongly demanded a clear explanation from the hospital. On August 20, 2010, after thorough preparation, Attorney Cao, along with Attorney Zhang Qingping, attended the medical malpractice technical appraisal for Chen Wei at the Shenzhen Medical Association. During the appraisal, Attorney Cao vigorously argued on behalf of the parties, presenting each instance of the hospital's negligence during the medical process to the medical experts. Feeling immense pressure, Shenzhen Henggang People's Hospital subsequently called several times to request negotiation and mediation. After arduous efforts and repeated attempts, on September 7, 2010, Assistant Attorney Zhang Qingping went to the Henggang Court and reached a mediation agreement with representatives of Shenzhen Henggang People's Hospital and Peking University Shenzhen Hospital. On the afternoon of September 9, 2010, the hospital paid 390,000 RMB in compensation.
