[Shenzhen Municipal Bureau of Justice] Training on the management of Shenzhen's lawyer industry was successfully held.
From June 16 to 17, 2017, the Shenzhen lawyer industry management training was held, with nearly 80 participants including the city's Lawyers Association council, supervisory board, district work committees, and professional committee directors. Mei Aimin, inspector of the Shenzhen Municipal Bureau of Justice, and Xiong Songqing, director of the Lawyer and Notary Management Division, attended the meeting. The meeting was chaired by Lin Changchi, president of the city's Lawyers Association.
Director Xiong Songqing offered the following suggestions on further improving lawyer management: first, further refine the "dual-combination management system," fully leveraging the advantages of administrative and industry management, and based on numerous beneficial explorations such as democratic elections and democratic management, research and develop a management system suited to the times; second, further explore methods of supervision and guidance, clarify the functions of supervision, guidance, and self-discipline management, and research new management approaches that align with the new developments and address new issues in the lawyer industry; third, further establish and improve multi-party linkage mechanisms, streamline the working relationships between the association and its secretariat with judicial administrative departments at all levels and the industry party committee, stimulate internal momentum, and drive industry development and prosperity; fourth, further foster close cooperation, mutual coordination, complementary advantages, and resource sharing, fully leverage the cohesion and authority of the Lawyers Association, strengthen the secretariat's construction, and lay a solid foundation for the judicial administrative organs' lawyer management work.
Inspector Mei Aimin conveyed the spirit of the document "Opinions on Further Strengthening the Construction of Lawyers Associations" issued by the Ministry of Justice, interpreting the guiding ideology, work principles, main objectives, and key tasks for further strengthening the construction of lawyers associations. He hoped that the city's Lawyers Association would further enhance ideological and political construction, organizational construction, work style construction, party construction, and information technology construction, improving the association's ability to perform its duties and self-discipline management.
Inspector Mei Aimin relayed Director Jiang Xilin's requirements for the new work team: first, proceed from the big picture, seeking common ground while reserving differences; second, adhere to the leadership of the party, carrying out work around the central tasks of the municipal party committee and government; third, strengthen unity and further consolidate the work foundation.
Regarding how the new team will carry out its work, Inspector Mei Aimin pointed out: Over the years, the Shenzhen Bar Association has pioneered institutional reforms and construction nationwide, but there remains a gap in legal service quality compared to Beijing, Shanghai, and other places. The Bar Association should actively guide the government to increase support for the legal profession from the perspective of promoting industry development, shifting from a "political-legal mindset" to "promoting economic construction and development." It should strengthen research on macro policies, enhance investigation and study of industry development, fully listen to opinions and suggestions from lawyers and representatives, and propose a "package" of practical solutions and recommendations. Execution capacity must be improved to push forward the implementation of the Lawyers Academy and the revision of the Charter, ensuring tangible results. The Judicial Bureau will urge the Municipal Party Committee to convene a citywide lawyers' work meeting to effectively resolve urgent issues in industry development.
President Lin Changchi put forward several expectations for the new team: First, maintain the passion from the election campaign and overcome work difficulties; second, plan comprehensively, strategize, actively formulate work plans and progress schedules for this term, and regularly report achievements; third, focus on execution, fully leverage the role of each committee to discover, cultivate, retain, and utilize talent; fourth, establish a scientific evaluation mechanism, promptly report performance, actively accept representative supervision, and be accountable to representatives; fifth, properly handle relationships with the Supervisory Board, Secretariat, lawyer representatives, law firms, and other work bodies, work together with unity, remember the mission, and fulfill campaign promises.
Supervisory Board Chairman Wei Hanjiao briefly introduced the board's work rules, key tasks, and supervision philosophy: First, deepen the value orientation of co-construction, sharing, inclusiveness, and equality. The work focus of each committee should align with its functions, and the benefits of work outcomes should be broadened; second, take institutions as a guide, balancing rationality and assertiveness. On the basis of respecting rules and the contributions of all team members, the board will make rational judgments on the work of supervised entities by synthesizing evaluations from all parties; third, combine pragmatism with long-term effectiveness. Strengthen the principle that "supervision yields results and outcomes," urge the Council to deliver practical benefits to lawyers, establish long-term mechanisms in institutional development, and demonstrate rational depth, wisdom, human warmth, and fairness in supervision work.
Wei Bin, researcher from the Municipal Judicial Bureau Office, lectured on "Opportunities and Challenges for the Legal Profession in the Big Data Era," arguing that we must fully seize historical opportunities to become builders of industry data strategies, makers of standards, guides for open applications, innovators of business models, and promoters of legislative system construction.
Law Association Council Member Zhao Dongchuan analyzed the complaints received by the association over the past five years and, in conjunction with the "Lawyer Practice Standards," detailed the newly implemented "Disciplinary Rules for Lawyer Association Member Violations" and typical cases, serving as a constant warning.
Law Association Secretary-General Wang Hong briefly introduced the association's rules, financial system, and work procedures. By comparing data on lawyers, law firms, business income, and GDP contribution rates in Shenzhen's legal industry—including their scale, district distribution, and changes—she deeply analyzed the development trends of the city's legal profession.
President Li Chun taught the attendees about the functions and scope of the Lawyers Association, and shared his experiences in handling several relationships in industry management and work insights based on his own tenure. He encouraged the new working team to enhance learning ability, possess innovation capability, maintain inheritance ability, and have strategic responsibility, becoming a "gentleman" legal professional and a "gentleman" member of the Lawyers Association.
Lawyer Chen Fang shared "How to Fulfill the Duties of a Council Member." He believed that council members should establish a correct work attitude, act as industry managers, service providers, and image representatives, be familiar with work procedures, fulfill work responsibilities, and truly address the urgent needs of lawyers and do what lawyers require. He also introduced the work experience of the Provincial Lawyers Association, providing new ideas for the efficient work of the new team.
In the session on the work plan for the 10th Lawyers Association, Vice Presidents Zhang Cheng, Cai Hua, Yang Xiao, Yin Chenggang, Zeng Mai, Jiang Dinghang, Han Jun, and Wang Tengfeng of the Municipal Lawyers Association briefly introduced the work plans for their respective specialized committees. First, actively prepare for the Lawyers College, uphold rights and discipline with a "raise the flag and draw the sword" approach, list the rights and responsibilities of committees, and ensure smooth progress in all work. Second, lead industry services with public welfare, gather the voices of member representatives, promote the public defender system to advocate for the industry, and deepen the construction of the legal professional community. Third, advance the business training and cultural development of young lawyers simultaneously, steadily promote research on the survival and development of lawyers and law firms, gradually build OA management systems for law firms and joint office platforms for small and medium-sized firms, and undertake the heavy task of establishing rules and regulations. Fourth, promote the implementation of the 13th Five-Year Development Plan and the talent strategy for industry development, advance industry informatization, improve the rationality and targeting of fund use, explore the establishment of a business development fund, actively guide lawyers to seek innovation, results, and business products from the market, and vigorously promote business development. Fifth, fully leverage the role of lawyers in participating in political and public affairs, advance the construction of the public legal service system, ensure the implementation of the legal professional community, and promote the work for senior lawyers with the goal of "providing for the elderly." Sixth, consolidate and strengthen the work for interns while continuously innovating, sustain traditional sports events, plan early for the 30th anniversary event, promptly introduce welfare plans for senior lawyers, young lawyers with less than five years of practice, and female lawyers, and establish evaluation standards for outstanding law firms and outstanding lawyers. Seventh, continue to build an international exchange platform, promote the gradual implementation of cooperation projects, closely align with the national Belt and Road development strategy, promote the implementation of support policies for Qianhai lawyers, and strengthen exchanges and cooperation between female lawyers and their counterparts from Hong Kong, Macao, and Taiwan. Eighth, advance training work toward innovation, practicality, and depth, combine regular and dynamic publicity, improve cooperation with the media, promote the development of micro-films for the legal profession, and aim to enhance both the quantity and quality of legal services through public relations, comprehensively serving the development of the legal profession.
President Lin Changchi stated in his summary that the training course was well-structured, intensive, and rich in information. The leaders of the Municipal Bureau provided high-level guidance, the keynote speakers generously shared their knowledge, and the specialized committees actively planned and worked with determination.
The Municipal Lawyers Association will closely align with the national Belt and Road development strategy, leverage the leading role of large law firms in the industry, advocate for Shenzhen lawyers to pursue scale, branding, and internationalization, and strengthen and expand the Shenzhen legal profession. "When the tide comes, raise the sails and head to the sea," he said. He noted that the current central tasks of the Council are: First, in the era of Internet+, initiate a brainstorming session to improve risk management, business development, and case handling levels of law firms, guide small and medium-sized law firms toward standardization, specialization, and excellence, actively strengthen industry informatization based on the Judicial Bureau's information platform, enhance lawyers' case handling efficiency, and save judicial resources. Second, establish a guiding ideology that combines institutional rights protection and case-specific rights protection, promote the revision of the "Shenzhen Special Economic Zone Lawyers Regulations," advance the construction of the public defender system, comprehensively deepen the construction of the legal professional community, safeguard lawyers' practice rights, establish a Lawyers College, and seize every moment.
Supervisor-in-Chief Wei Hanjiao stated in his supervisory opinion that the meeting was well-organized, with a tight schedule and fruitful outcomes. The Supervisory Board will work with a mindset of openness, respect, and understanding, treating effective supervision as the result of its work and as the future hope for the development of the industry association. The Supervisory Board will strongly support all work of the Council, unreservedly offer opinions and suggestions, and walk alongside the Council, sharing both challenges and successes.
After the meeting, the Council and the Business Innovation and Development Committee respectively convened working meetings of specialized and professional committees to deploy the recent work of the association.
All participants attended the full training and expressed that this high-intensity, fast-paced "introductory course" was highly rewarding, with comprehensive and thorough curriculum helping them further understand the "two-in-one" management system, clarify various association regulations, gain in-depth knowledge of industry development, and establish good working relationships.
"Once the great roc rises with the wind, it soars straight up to ninety thousand miles." This meeting has sounded the horn for progress. On the beautiful Dapeng Peninsula, all specialized, professional, and district working committees will set sail from here and voyage far!
