Why do lawyers both admire and disdain each other?
Today is not only the first day of July, but also the 101st anniversary of the founding of the Communist Party of China and the 25th anniversary of Hong Kong's return. On this festive occasion celebrated across the nation, we once again welcome a lecture by a lawyer from Guangdong Zhiming Law Firm. The theme of his speech this time is "Relationships Among Lawyers." Lawyers are both legal professionals and wordsmiths engaged in textual and cultural work. Therefore, lawyers exhibit both the phenomenon of literati appreciating one another and that of literati disparaging one another. This differs from the police, of whom people often say, "All police under heaven are one family," because the police are fundamentally guaranteed by public power and, out of a public-spirited commitment to law enforcement, support and coordinate with one another. Attorney Zhiming believes that lawyers disparaging their peers is a normal phenomenon, a widespread phenomenon, and a majority phenomenon; whereas lawyers appreciating their peers is a specific phenomenon, a special circumstance, and a minority phenomenon. Thus, to loosely joke that "all lawyers under heaven are foes" is not an exaggeration. Although exceptions exist among both lawyers and police, as a decent and professional lawyer, Attorney Zhiming hopes everyone can uphold the original intent and true meaning of the rule of law, hone their skills well, and practice law through the righteous path to protect the law and serve the people—and in doing so, most will naturally be able to appreciate and yield to one another.
While everyone was still engrossed in the discussion, Lawyer Zhiming shared a classic case of his own, "The Case of Duan's Fight for an Adopted Son Resulting in the Loss of Both Money and Person to the Other Woman." The case was highly complex, and the lawyer entrusted by the client Duan during the first instance was utterly unable to manage it, leading to Duan's loss. Duan had no choice but to seek help from Lawyer Zhiming, who specializes in major, difficult, and complex cases, during the appeal stage. At this point, Lawyer Zhiming kept everyone in suspense; instead of explaining how he revived this seemingly hopeless situation, he encouraged the audience to think divergently and share their own views. After a round of discussion, Lawyer Zhiming slowly explained how he used literary rights protection litigation to approach the case from the angles of emotion, reason, and law, ultimately convincing the judge that the facts and reasoning of our appellant side were highly and substantively consistent with legal principles, and securing a favorable verdict for our appeal.
