NetEase News reported: "On April 10, 2020, in Weifang, Shandong, a father and son drove a three-wheeler with a chainsaw to cut down trees by the roadside. Over a hundred-meter stretch, 41 stumps remained. Chen Pengliang, the party branch secretary of Subutun Village, saw this and immediately stopped them and called the police. Investigation revealed that the two men, a father and son, were hired by another man to illegally log trees for money. Among the over 40 golden willows, more than 20 had been cut and sold earlier, while those cut on the afternoon of the 8th were discovered and seized before they could be sold. The police took the three men to the police station, and the case is under further investigation."
According to Article 345 of China's Criminal Law, the crime of illegal logging refers to violating national forest protection regulations, with the intent of illegal possession, arbitrarily cutting down forests or other trees owned by the state, collectives, or individuals, in a relatively large quantity. According to judicial interpretation, "relatively large quantity" means: in forest areas, logging 2–5 cubic meters of timber or 100–250 saplings; in non-forest areas, logging 1–2.5 cubic meters of timber or 50–125 saplings.
According to Article 72 of the "Provisions on Standards for Filing and Prosecuting Criminal Cases under the Jurisdiction of Public Security Organs (I)" by the Supreme People's Court and the Ministry of Public Security, illegal logging of forests or other trees involving any of the following circumstances shall be filed and prosecuted: (1) logging 2 to 5 cubic meters or more.
