On May 13, in Xi'an, Shaanxi, Zhao was stopped for driving after drinking. What surprised the traffic police was that Zhao said, 'The day I first got my driver's license was May 13, which is today.'

Zhao said: 'It only took me two or three hours to get the license. I went to drink to celebrate right after getting the driver's license. Unexpectedly, on the way home driving, we were stopped by the traffic police. We were just near the intersection by our home. Who would have thought there would be traffic police checking?'

So, under what circumstances would a driver's license be revoked?
 
Four situations that lead to license revocation and the corresponding regulations:
 
1. [License Revocation for Drunkenness]
 
Article 91 of the Road Traffic Safety Law
 
Driving a motor vehicle after drinking alcohol will result in a temporary suspension of the motor vehicle driving license for six months and a fine of no less than one thousand yuan and no more than two thousand yuan. If a person who has been punished for driving a motor vehicle after drinking drives again after drinking, they will face detention of up to ten days, a fine of no less than one thousand yuan and no more than two thousand yuan, and revocation of their motor vehicle driving license.
 
If a person drives a motor vehicle while intoxicated, they shall be restrained by the traffic management department of the public security organ until sober, their motor vehicle driving license shall be revoked, and they shall be held criminally responsible according to law; they shall not be allowed to obtain a motor vehicle driving license again within five years.
 
Driving a commercial motor vehicle after drinking alcohol shall be punished by detention for fifteen days, a fine of five thousand yuan, revocation of the motor vehicle driving license, and prohibition from obtaining a new motor vehicle driving license within five years.
 
Driving a commercial motor vehicle while intoxicated will result in being restrained by the public security traffic management department until sober, revocation of the motor vehicle driver's license, and criminal liability in accordance with the law; the individual shall not obtain a motor vehicle driver's license again within ten years, and after obtaining a new motor vehicle driver's license, shall not drive a commercial motor vehicle.
 
If a person drives a motor vehicle after drinking alcohol or while intoxicated and causes a major traffic accident, constituting a crime, they shall be held criminally responsible according to law, and the traffic management department of the public security organ shall revoke their motor vehicle driver's license, and they shall never be allowed to obtain a motor vehicle driver's license again.
 
2. [Handing over a motor vehicle to a person without a driving qualification and speeding]
 
Article 99 of the Road Traffic Safety Law
 
(2) Entrusting a motor vehicle to a person who has not obtained a motor vehicle driving license or whose motor vehicle driving license has been revoked or suspended;
 
(4) Motor vehicles exceeding the prescribed speed limit by 50%;
 
If the actor falls under item 2 or item 4 of the preceding paragraph, the motor vehicle driving license may be revoked concurrently;
 
3. [Driving a dismantled scrap car]
 
Article 100 of the Road Traffic Safety Law

Driving a motor vehicle that is assembled or has reached the scrapping standard on the road, the traffic management department of the public security organ shall confiscate it and enforce its scrapping.
 
For drivers who drive the motor vehicles listed in the preceding paragraph on the road, a fine of more than 200 yuan but less than 2,000 yuan shall be imposed, and their motor vehicle driving license shall be revoked.
 
4. [Crime of Traffic Accident]
 
Article 101 of the Road Traffic Safety Law
 
If the provisions of the Road Traffic Safety Law and regulations are violated, causing a major traffic accident and constituting a crime, criminal responsibility shall be pursued according to law, and the motor vehicle driving license shall be revoked by the traffic management department of the public security organ.
 
Anyone who flees the scene after causing a traffic accident shall have their motor vehicle driving license revoked by the public security traffic management department and shall never be permitted to obtain a motor vehicle driving license again.
 
Can you retake the driving test after your license is revoked?
 
It is necessary to consider the specific reasons why the person's driver's license was revoked in order to determine when they can apply to take the driving test again.
 
Article 13 of the "Regulations on the Application for and Use of Motor Vehicle Driver's Licenses":
 
A person with any of the following circumstances shall not apply for a motor vehicle driver's license:
 
(1) Those with organic heart disease, epilepsy, Ménière's disease, vertigo, hysteria, Parkinson's disease, mental illness, dementia, and other nervous system diseases that affect limb movement and hinder safe driving;
 
(2) Having engaged in drug use or injection within the past three years, or having not yet completed three years since the removal of compulsory isolation detoxification measures, or long-term addiction to dependent psychotropic drugs that has not yet been cured;
 
(3) Causing a traffic accident and then fleeing constitutes a crime;
 
(4) Driving a motor vehicle after drinking or while intoxicated and causing a major traffic accident, constituting a crime;
 
(5) Driving a motor vehicle under the influence of alcohol or driving a commercial motor vehicle after drinking, and having one's motor vehicle driving license legally revoked for less than five years;
 
(6) Driving a commercial motor vehicle under the influence of alcohol and having the motor vehicle driver's license revoked by law for less than ten years;
 
(7) In cases where the motor vehicle driver's license has been revoked for less than two years due to other circumstances according to law;
 
(8) Driving license revoked less than three years in accordance with the law;
 
(9) Other circumstances provided for by laws and administrative regulations.
 
Driving a motor vehicle without obtaining a motor vehicle driving license, if one engages in any of the acts from Item 5 to Item 7 of the first paragraph, shall not apply for a motor vehicle driving license within the prescribed period.
