If you flee after committing murder for more than 20 years, can you no longer be prosecuted? Check out these exceptions quickly.

Recently, the Yueyang Intermediate People's Court in Hunan Province pronounced a first-instance verdict in the intentional homicide case of defendant Xu Mou, sentencing him to death and depriving him of political rights for life. Thus, after fleeing for 23 years following the unprovoked murder of a young girl, Xu Mou has finally faced severe punishment!
Case Summary
Around 3:00 p.m. on January 10, 1997, villager Xu Mou from Dongfeng Village, Baiyangtian Town, Linxiang City, encountered a female student named Xiao Rong (pseudonym, deceased at age 11) on his way home after eating at someone else's house. She had taken leave from school due to a headache. Xu knew this girl from the same village, as her father had worked with him at a local mine. Xu questioned her about why she wasn't in school. Xiao Rong, frightened by his aggressive tone and strong smell of alcohol, quickened her pace to leave. Xu followed her to a field ridge surrounded by hills on three sides. Xiao Rong screamed for help in fear. Seeing this, Xu pushed her into a paddy field, pressed her head into the muddy water, and drowned her. During this, villager Wang Mouxiang, who was cutting firewood on a nearby mountain, heard Xiao Rong's cries and responded loudly. Fearing exposure, Xu hid Xiao Rong's body beside a woodpile on the ridge and chased after Wang until she ran back to the village compound and joined other villagers.
Around 5:00 p.m., Xu told his brother Xu Mouliu (separately prosecuted) about the murder and asked him to help bury the body. The brothers then took hoes to the scene, moved the body to a nearby hillside, and buried it. That night, Xu returned to the murder site, picked up Xiao Rong's belongings, found a pen and paper in her schoolbag, imitated her handwriting and tone to forge a note suggesting she had run away from home, and placed these items and the note in a bamboo basket at her doorstep. Early the next morning, Xu fled to Yueyang. Later that day, he returned home under the pretext of attending a funeral in a neighboring village. Sensing a change in villagers' attitudes toward him and fearing exposure, he exhumed Xiao Rong's body in the early hours of January 12, moved it to a more distant mountain area for reburial, and then fled.
That year, the public security organs filed a case regarding Xiao Rong's disappearance. Xu Mouliu confessed to burying the body with Xu, but no body was found at the burial site he described and identified, and the hoe used in the crime has never been recovered. The public security organs later listed Xu as a "three-type fugitive," and in 2015, he was placed on the online wanted list.
On August 26, 2019, the public security organs in Chibi City, Hubei Province, detected Xu's traces through the "Skynet" facial recognition system and immediately began tracking him. On August 28, Xu was captured at a construction site in Chibi. Xu confessed that over 22 years, he had used multiple aliases to hide in Guangdong, Beijing, Henan, Hubei, and other places. Based on his confession, the public security organs found Xiao Rong's remains in a mountain area at the Qiaotou Group of the former Dongfeng Village.
Court judgment
The Yueyang Intermediate People's Court held that Xu murdered a young girl without cause, fled to other places for over 20 years, and although he truthfully confessed to the crime after arrest, he refused to disclose the motive, which did not warrant a lighter sentence. The circumstances were particularly heinous, and the consequences were especially severe. His actions constituted intentional homicide, and he was sentenced to death and deprived of political rights for life.

Article 87: Statute of Limitations for Prosecution
No prosecution shall be initiated after the following periods have elapsed from the commission of a crime:
(1) Five years, if the maximum statutory punishment is fixed-term imprisonment of less than five years;
(2) Ten years, if the maximum statutory punishment is fixed-term imprisonment of five years or more but less than ten years;
(3) Fifteen years, if the maximum statutory punishment is fixed-term imprisonment of ten years or more;
(4) Twenty years, if the maximum statutory punishment is life imprisonment or the death penalty.

If the victim files a complaint within the statute of limitations, and the People's Court, public security organ, or state security organ should have filed the case but fails to do so, the statute of limitations shall not apply.

[4] Although Article 87 of the Criminal Law specifies time limits for the statute of limitations for crimes—for example, if the maximum statutory penalty is life imprisonment or the death penalty, the statute of limitations is twenty years—the law also retains an exception rule: if prosecution is deemed necessary after twenty years, it may be submitted to the Supreme People's Court for approval.
[5] In addition to this exception rule, Article 88 of the Criminal Law also provides for the extension of the statute of limitations, mainly including the following two situations:
[6] First, after a case has been filed for investigation by a People's Court, public security organ, or state security organ, or after a People's Court has accepted a case, if the offender evades investigation or trial, the statute of limitations shall not apply. That is, as long as the judicial authorities have initiated investigation or trial proceedings and the offender intentionally evades them, prosecution can be pursued regardless of how much time has passed.
2. If the victim files a complaint within the statute of limitations, and the people's court or public security authority should file a case but fails to do so, the statute of limitations shall not apply. This provision is intended to prevent the public from being unable to seek justice due to the authorities' mutual buck-passing, which could cause the case to exceed the statute of limitations.
3. The extension of the statute of limitations primarily reflects the theory of general crime prevention. Once judicial authorities have initiated prosecution proceedings, from the perspective of judicial deterrence, they should not easily terminate them. The interruption of the statute of limitations mainly embodies special prevention for offenders. If an offender has not committed a crime for a long time, it proves they may have reformed and turned over a new leaf, making further punishment unnecessary. After all, for criminals, the torment of conscience itself is a form of punishment. However, if an offender commits another crime within the statute of limitations, it proves they have not repented at all. Such individuals who have lost their conscience naturally warrant continued accountability.
4. It is worth noting that the statute of limitations system is often linked to joint crimes. If the principal offender in a case is convicted, their statute of limitations is at least twenty years. For other participants in the case, regardless of the severity of their crimes, the statute of limitations should align with that of the principal offender. Although China's criminal law does not explicitly stipulate this, the essence of joint crime theory is the overall responsibility for partial acts. In other words, a joint crime is a whole; each participant, though only committing partial acts, must bear responsibility for the entire joint crime, and the statute of limitations system naturally must follow the basic principles of joint crime theory.
