Case review
In 2018, Mr. Sun and his spouse applied for a loan to purchase a new home together. However, during the loan application process, he was informed by bank personnel that his personal credit had multiple adverse records over the past three years, and as a result, his mortgage application had been rejected by the head office.
Mr. Sun was puzzled—he had never borrowed money from anyone or applied for any credit cards, so why were there multiple negative records? He immediately asked the bank staff to check the relevant information. It turned out that four credit cards had been issued under his name, each with tens of thousands of yuan in cash advances and overdue repayment records. According to the card application details, these four cards were processed by a man surnamed Chen using a copy of Mr. Sun's ID card.
Mr. Sun immediately called the police. Investigation revealed that Mr. Sun's mother, in order to receive free laundry detergent, had given the ID cards of her son, daughter-in-law, husband, and herself to criminals for “registration.” As the criminal gang involved a relatively large amount of money, the police have already filed a case for investigation.

1、 State organs or relevant units must not arbitrarily copy or retain residents' ID cards.
According to the "Announcement on Regulating the Use and Management of Resident ID Cards," state organs or relevant units and their staff must not arbitrarily copy or scan resident ID cards, nor retain or mortgage citizens' resident ID cards. During the performance of duties or provision of services, staff must verify the consistency of the person and the ID card on the spot and must not arbitrarily record the personal information contained in the resident ID card.
However, there are three exceptions: first, when a citizen's household registration is canceled due to emigration or death; second, when renewing a new generation resident identity card, the original card has expired, is severely damaged, or contains registration errors; third, when a criminal suspect is under residential surveillance, public security authorities may temporarily withhold their identity card as needed for the case.
2. Enterprises and individuals are also prohibited from withholding resident identity cards.
According to the "Announcement on Regulating the Use and Management of Resident Identity Cards," employers must not withhold workers' identity cards or other documents, nor demand guarantees or collect property from workers under any other pretext. Violators will be ordered by the labor administrative department to return the items within a specified period and fined between 500 and 2,000 yuan per person.
Individuals who unlawfully withhold another person's resident identity card will be warned by public security authorities and fined up to 200 yuan; any illegal gains will be confiscated.
3. Citizens should properly safeguard their identity cards, and the state and relevant units should establish effective systems.
The Announcement on Regulating the Use and Management of Resident Identity Cards requires that state organs or relevant entities establish a "blacklist" system for individuals with poor credit records. Individuals who fraudulently use another person's resident identity card shall be included in the "blacklist" database of poor credit records, and an information-sharing mechanism shall be established to impose necessary restrictions when performing duties or providing services, thereby promoting the implementation of a joint punishment mechanism.
