[4] Recently, Xingyin Information Technology (Shanghai) Co., Ltd., the affiliate company of Xiaohongshu, received a new administrative penalty. The specific reason is: the network service provider discovered that users published and disseminated information containing content harmful to the physical and mental health of minors, but did not immediately stop transmitting the relevant information or take measures such as deletion, blocking, or disconnecting links.

 
 

[5] In view of the above illegal facts, on January 14, the Huangpu District Culture and Tourism Bureau of Shanghai, in accordance with Article 127 of the "Minors Protection Law of the People's Republic of China," issued a warning to Xingyin Information Technology (Shanghai) Co., Ltd. and imposed a fine of 300,000 yuan, two penalty decisions.

[6] According to a previous report by CCTV Finance, Xiaohongshu was exposed for pushing videos of minors' body privacy. The video shooters were all minors themselves, who directly aimed the camera at their private parts when taking selfies with their phones. In the short videos involving minors, there were also a large number of user comments and bullet comments, some of which carried strong sexual implications.

Subsequently, Xiaohongshu responded that some of the content mentioned in the report had already been addressed in the platform's previous special review of minors. Regarding real-name authentication, the platform strictly follows relevant regulations, requiring real-name authentication for users, including new registrants and those posting notes or comments, who must bind a personal phone number, while professional certification and e-commerce users must upload their personal ID.

Article 80
If a network service provider discovers that a user is publishing or disseminating information that may affect the physical and mental health of minors without providing a prominent warning, it shall issue a warning or notify the user to do so; if no warning is given, the relevant information shall not be transmitted. If a network service provider discovers that a user is publishing or disseminating information containing content harmful to the physical and mental health of minors, it shall immediately stop transmitting the relevant information, take measures such as deletion, blocking, or disconnecting links, retain relevant records, and report to the cyberspace administration, public security, and other departments. If a network service provider discovers that a user is using its network services to commit illegal or criminal acts against minors, it shall immediately stop providing network services to that user, retain relevant records, and report to the public security authorities.
 
Article 127
If an information processor violates Article 72 of this Law, or if a network product or service provider violates Articles 73, 74, 75, 76, 77, or 80 of this Law, the relevant departments such as public security, cyberspace administration, telecommunications, press and publication, radio and television, and culture and tourism shall, according to their respective responsibilities, order correction, issue a warning, confiscate illegal gains, and if the illegal gains exceed one million yuan, impose a fine of not less than one time but not more than ten times the illegal gains; if there are no illegal gains or the illegal gains are less than one million yuan, impose a fine of not less than 100,000 yuan but not more than one million yuan; and impose a fine of not less than 10,000 yuan but not more than 100,000 yuan on the directly responsible supervisors and other responsible persons; if correction is refused or the circumstances are serious, they may also order the suspension of relevant business, rectification, closure of the website, revocation of the business license, or revocation of the relevant permit.
