Case review
Recently, a media outlet posted a video on Weibo. In the video, at a certain intersection in Hainan, a man riding a shared bicycle got into a dispute with a man and a woman riding an electric bike. When the traffic police were handling the situation on the scene, they noticed that the man riding the shared bicycle smelled of alcohol. When asked if he had been drinking, he replied, 'What's wrong with me drinking while riding a bicycle?' Subsequently, the traffic police tested the man's blood alcohol content, which was 112g/100ml, and determined it to be 'drunk driving' of a non-motor vehicle.

This Weibo post has received widespread attention. Some netizens expressed confusion, saying that the speed of non-motor vehicles is usually far lower than that of motor vehicles, and in daily life, traffic police rarely specifically check for drunk driving by non-motor vehicles. Some people even deliberately choose to ride bicycles to drink, in order to avoid being checked for motor vehicle 'drunk driving.' Could riding a bicycle after drinking also be illegal?

Regulations on the Implementation of the Road Traffic Safety Law of the People's Republic of China
Article 72
Riding bicycles, tricycles, electric bicycles, and motorized wheelchairs for people with disabilities on the road shall comply with the following regulations:
……
(3) Do not drive under the influence of alcohol;
……

[1] The author's perspective
The legally concerned behavior of driving under the influence is divided into two categories based on the driver's blood alcohol content: drinking and driving, and drunk driving. Drinking and driving refers to driving after consuming alcohol, specifically when the driver's blood alcohol content is greater than or equal to 20mg/100ml but less than 80mg/100ml. Drunk driving refers to situations where the driver's blood alcohol content is greater than or equal to 80mg/100ml. If the vehicle being driven is a motor vehicle, meeting the latter standard constitutes suspicion of the crime of dangerous driving under the Criminal Law.

Because people rarely hear about traffic police checking for drunk driving on non-motor vehicles in daily life, they do not know that this is illegal. This case not only reminded the general public, but also emphasized once again the dangers of driving under the influence of alcohol. Whether driving a motor vehicle or a non-motor vehicle, for the safety of oneself and others, one must choose the safest way to get home. After all, there are thousands of roads, but safety comes first.
