You Xu (formerly known as You Moumei), who once publicly accused "Langweixian" of abandoning its benefactor and poaching the company's employees under the identity of "Founder of the Langweixian IP," was reported to the authorities by her former employer, Chongqing Tianquanxing Culture Media Co., Ltd. (hereinafter referred to as "Tianquanxing Company"), which alleged that she illegally misappropriated more than 4 million yuan in company funds.

 
 

Case review
In July 2020, Tianquanxing Company reported You Moumei to the Yubei Branch of the Chongqing Public Security Bureau for embezzlement. The police closed the case on the grounds that there was no criminal fact. After Tianquanxing Company supplemented relevant materials and reported the case again, the Yubei Public Security Sub-bureau opened an investigation into the case of You Moumei's suspected embezzlement in June 2021.

 
 

It is reported that the case of You Moumei's suspected embezzlement has been transferred by the Yubei police to the Economic Investigation Corps of the Chongqing Public Security Bureau for handling. She has been arrested, and the case has not yet been transferred for prosecution.
 
Meanwhile, the Chongqing No. 1 Intermediate People's Court ruled in the first instance that the Douyin and Kuaishou livestreaming accounts under the name "Langweixian," controlled by You Moumei, belong to Tianquanxing Media Company, and ordered her to hand over the account credentials and passwords. After You Moumei appealed, the Chongqing High People's Court recently issued a second-instance judgment dismissing her appeal and upholding the original ruling.

An employee of a company, enterprise, or other entity who, taking advantage of his or her position, unlawfully appropriates the entity’s property for personal gain, if the amount involved is relatively large, shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention, and shall also be fined; if the amount involved is huge, shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years, and shall also be fined; if the amount involved is especially huge, shall be sentenced to fixed-term imprisonment of not less than ten years or life imprisonment, and shall also be fined   .

In recent years, mukbang influencers rose to prominence seemingly overnight, and "Langweixian" was one of them. The collaboration between You Moumei and Tianquanxing Company also proved to be a successful trial, making them among the first to brave the unknown. However, what began as a promising partnership has now deteriorated into a bitter falling-out, driven not only by differences in business philosophy but also by personal greed. In this case, Tianquanxing has consistently alleged that You Moumei misappropriated company funds and concealed the true revenue of the livestreaming accounts. Yet this also reveals Tianquanxing Company’s lax management, as otherwise You Moumei’s unlawful conduct would have been discovered much earlier.

However, an influencer's popularity requires constant updates to maintain; over time, not only does their popularity suffer, but their economic interests also decline. This shows that once the cooperative relationship between an influencer and a company breaks down, both parties are likely to be affected. Therefore, at the start of cooperation, one should not only focus on future benefits but also pay attention to the current contract terms, as this contract is both a guarantee of interests and the foundation of cooperation.
