"Criminal Law of the People's Republic of China"
[3] Article 291 bis
[4] Whoever throws objects from a building or other height, if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than one year, criminal detention, or public surveillance, and/or a fine.
[5] If the act in the preceding paragraph also constitutes another crime, it shall be convicted and punished in accordance with the provisions for the heavier penalty.
[1] The author's perspective
In recent years, it may not be common to encounter a pie falling from the sky, but incidents of knives falling from above are frequently heard. Regardless of the object that falls, it poses an extremely uncertain hazard to pedestrians below, seriously endangers public safety, infringes on the legitimate rights and interests of the people, and affects social harmony and stability. Therefore, such malicious incidents must be eliminated.
Since China criminalized高空抛物 (throwing objects from heights), it has already deterred many people. However, law enforcement and judicial adjudication must not be relaxed. Relevant departments should fully leverage the punitive, regulatory, and preventive functions of judicial trials, properly handle cases of高空抛物 and falling objects in accordance with the law, and effectively safeguard the "safety above the heads" of the people, so as to ensure the people live and work in peace and maintain social fairness and justice.
