The website of the Beijing Municipal Cultural Market Comprehensive Law Enforcement General Team shows that recently, Shanghai Xiaoxing Culture Media Co., Ltd. was fined 70,000 yuan by the Beijing Municipal Bureau of Culture and Tourism for engaging in commercial performance business activities without authorization.
Case review
Previously, due to the incident in which stand-up comedian Li Haoshi (stage name: House) made inappropriate remarks insulting the people's army during a performance, on May 17, the Beijing Municipal Bureau of Culture and Tourism imposed administrative penalties on Xiaoguo Culture: a warning, confiscation of illegal gains of 1,325,381.6 yuan, and a fine of 13,353,816 yuan. Subsequently, Beijing and Shanghai also required Xiaoguo Culture to suspend performances.
On May 17, the official Weibo account of the Chaoyang Branch of the Beijing Municipal Public Security Bureau announced that in response to a situation in which Li Moumou (male, 31), an actor of a certain cultural company, seriously insulted the people's army during a performance, causing a vile social impact, the public security organ has opened a case for investigation in accordance with the law.
Regulations on the Administration of Commercial Performances
Article 43
If any of the following acts is committed, the culture administration department of the county-level people's government shall ban it, confiscate the performance equipment and illegal gains, and concurrently impose a fine of not less than 8 times but not more than 10 times the illegal gains; if there are no illegal gains or the illegal gains are less than 10,000 yuan, a fine of not less than 50,000 yuan but not more than 100,000 yuan shall be concurrently imposed; if a crime is constituted, criminal liability shall be pursued in accordance with the law:
(1) Engaging in commercial performance activities without authorization in violation of Articles 6, 10, and 11 of these Regulations;

In recent years, stand-up comedy has sparked a wave of popularity, with not only more performers but also a broader audience. The rise of a cultural industry is a good thing, but careful consideration is needed in content selection and development paths.
The people's army is a strong guardian of national security and the people's well-being. No company or individual is allowed to wantonly slander it, nor is it permitted to turn serious subjects into entertainment. Relevant departments must strengthen oversight, strictly enforce the law, and resolutely oppose the pursuit of “laughs” at the expense of consequences and the pursuit of economic gain without regard for social responsibility.
