Hubei Teacher Dies from Electric Shock: Those Who Set Up the Electric Net Should Bear Criminal Responsibility
A tragic incident occurred in Yangxin County, Huangshi, Hubei. A 51-year-old teacher, while searching for his missing father in the mountains, was fatally struck by an illegally installed electric grid and died on the spot. This event not only brought immense pain to the victim's family but also sparked widespread societal concern over the act of privately setting up electric grids. So, should the person who installed the grid bear criminal responsibility?
According to reports, the teacher, pseudonym Chen Yong, was formerly a teacher at a town middle school and later transferred to serve as the principal of a public kindergarten. On the night of the incident, he received a call from his mother saying his father had not returned from gathering herbs in the mountains, so he went into the mountains with his wife to search. About a ten-minute walk from where they parked, Chen Yong was unfortunately struck by the electric grid and collapsed on the spot. Despite emergency rescue efforts by relatives and medical staff who arrived shortly after, his life could not be saved.
The key clue in this incident is the illegally installed electric grid. According to the family, there is a villager in his sixties who regularly sets traps, snares, and other devices in the mountains to catch wild game for sale, and they immediately suspected this person of installing the grid. In fact, under relevant Chinese laws, units or individuals are prohibited from privately installing electric grids without approval from relevant authorities. This regulation is based on the significant danger electric grids pose to humans and livestock, as well as considerations for public safety.
In this case, the electric grid that caused the teacher's death was placed in a non-private, open area, and the current was strong enough to be lethal, clearly posing a serious public danger. According to the Criminal Law of the People's Republic of China, those who commit arson, breach dikes, cause explosions, or release toxic, radioactive, or infectious disease pathogens, or use other dangerous methods to cause serious injury, death, or significant damage to public or private property, shall be sentenced to fixed-term imprisonment of not less than ten years, life imprisonment, or death. Those who negligently commit the above offense shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years; if the circumstances are minor, they shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention.
Therefore, if an organization or individual sets up an unauthorized electric fence with the intention of hunting but causes the death of another person, they undoubtedly constitute the crime of negligently endangering public safety by dangerous means. In this case, the suspect not only violated national laws prohibiting the installation of unauthorized electric fences but also caused the victim's death through their actions, thus they should bear corresponding criminal liability.
Additionally, the victim's family has the right to file civil compensation claims against the responsible party under the Civil Code of the People's Republic of China, including compensation for death, funeral expenses, and mental damages. This serves both as solace for the victim's family and as a legal sanction against the responsible party.
This tragedy once again reminds us that installing unauthorized electric fences is not only illegal but also extremely dangerous. It can pose a significant threat to people's lives and property, creating major risks to public safety. Therefore, we must resolutely prohibit such behavior, enhance legal awareness, and jointly maintain social harmony and stability. At the same time, any actions that violate legal provisions and endanger public safety should be severely punished according to the law, without leniency.
