[5] [Shenzhen Lawyers Association] Actively Leveraging the Role of Lawyers to Thrive the E-commerce Industry
On the morning of December 14, 2013, the E-Commerce Law Professional Committee of the Guangdong Lawyers Association, in conjunction with the Information Network and E-Commerce Law Business Committee of the Shenzhen Lawyers Association, co-hosted a seminar on “Selection of Civil Causes of Action, Evidence Presentation and Other Relevant Legal Issues in Unfair Competition and Copyright Infringement Cases in the Online Environment” at the Multi-Function Hall of the Shenzhen Lawyers Association. Lawyer Wang Tengfeng, Deputy Supervisor of the Guangdong Lawyers Association, attended the seminar, which was moderated by Lawyer Wang Jifeng, Director of the E-Commerce Law Professional Committee of the Guangdong Lawyers Association and Director of the Information Network and E-Commerce Law Business Committee of the Shenzhen Lawyers Association.
The seminar invited Judge Yu Chunhui, Presiding Judge of the Intellectual Property Division of the Shenzhen Intermediate People's Court, and Professor Zhu Xiequn, Master's Supervisor at the Law School of Shenzhen University, as keynote speakers. As a senior judge, Judge Yu explained the types of relevant cases, causes of action, rules of evidence, and legal matters requiring attention from the perspective of a judge's mindset, approach, and angle in handling intellectual property cases, particularly the trial requirements for copyright infringement cases in the online environment, while incorporating the characteristics of emerging cases such as private game servers and cheating software. Professor Zhu provided a brief interpretation from the perspective of legal research, covering the computer technology and legal provisions related to private game servers and cheating software, new industry developments, and in particular the latest methods of private game servers and cheating software——"interception, modification, and transmission of data between servers and clients"——as well as current and advanced practices and legal solutions in Europe and the United States. Attending lawyers engaged in interactive exchanges with the keynote speakers regarding the current handling of private game server and cheating software cases in Shenzhen, especially in the Nanshan District Court, including issues such as criminal charges and civil causes of action.
This seminar aimed to enhance lawyers' skills, techniques, and accuracy in handling similar intellectual property cases, with the goal of exploring and innovating new areas and methods of legal services, providing better legal services to clients, and leveraging the role of lawyers to promote the healthy and rapid development of the internet and e-commerce industries in our province and city.
