Zhiming Lecture Hall Session 2 – A Discussion on Shenzhen’s “Small Property Rights” Housing
On the afternoon of October 30, 2020, the second sharing lecture of the Zhiming Lecture Hall organized by Guangdong Zhiming Law Firm was livestreamed on the Tencent Classroom platform. The theme of the lecture was Talking About Shenzhen's Small Property Rights Housing, and Lawyer Peng Jiong of Guangdong Zhiming Law Firm was the guest speaker.
[3] During the live lecture, Lawyer Peng mainly discussed the concept and current status of small property rights housing, analyzing the differences between official and grassroots perspectives on such housing, and explaining why Shenzhen does not have small property rights housing. He also mentioned how Shenzhen handles the widespread issue of illegal buildings. Finally, through specific case analyses, he clarified the differences between small property rights housing and illegal buildings.
[4] In the interactive session, participants engaged in a heated discussion on how to handle disputes over the confirmation of rights for self-built and collectively built houses in Shenzhen. The lecture was lively and engaging, with everyone finding it refreshing and beneficial. At the end of the lecture, attendees expressed a desire for more similar lectures in the future, to enhance professional skills while fostering a vibrant learning atmosphere.
[5] In China's social life and judicial practice, there are numerous disputes over small property rights housing. However, previous substantive laws such as the "General Principles of Civil Law" and the "Contract Law" did not provide clear regulations on this issue. The lack of relevant laws has turned small property rights housing into a gray area, leaving both buyers and sellers without protection and courts without legal basis for judgments. Fortunately, Shenzhen promptly recognized this phenomenon and actively introduced local policies to regulate it. Only by effectively protecting people's rights and property can society and the legal system advance further.
