Case review
近日，时装零售巨头H&M因为把不合格产品冒充合格产品并销售，被罚没13.35元。

 
 

根据上海市普陀区市场监督管理局出具的行政处罚决定书显示，H&M关联公司海恩斯莫里斯（上海）商业有限公司款号为 047400 的衬衫，经检验，耐摩擦色牢度项目不符合相关标准要求，被判定为不合格。市场监督管理局于2020年11月11日对该公司立案调查。
 
经查，海恩斯莫里斯公司采购以不合格产品冒充合格产品的衬衫 374件，销售单价为129元，373件已销售完，销售金额为 48117元，剩余1件为抽样的备样产品。衬衫的货值金额为 48246元，违法所得37035.17元。
 
普陀区市场监管局称，该公司的行为已违反《产品质量法》。
 
2021年1月25日，普陀区市场监管局决定对该公司处罚款人民币9.6492万元，没收违法所得3.703517万元，没收违法销售的款号为047400的以不合格产品冒充合格产品的衬衫一件。

《产品质量法》
Article 39
When selling products, sellers shall not adulterate or mix impurities, shall not pass off fake products as genuine or inferior products as superior, and shall not pass off non-conforming products as conforming products.
 
Article 50
Adulterating or mixing impurities into products, passing off fake products as genuine, inferior products as high-quality, or substandard products as qualified shall result in an order to cease production and sales, confiscation of the illegally produced and sold products, and a fine of not less than 50% but not more than three times the value of the illegally produced and sold products; if there is illegal income, it shall be confiscated; if the circumstances are serious, the business license shall be revoked; if a crime is constituted, criminal liability shall be pursued according to law.

许多购买过H&M的消费者在看到这一新闻之后纷纷都表示“原来质量差并不是自己的错觉”。易变形、款式差、线头多……H&M的服装似乎在品控方面一直被诟病。可试想一下，在H&M营造的这种快时装背景下，平均两个星期就会换一批款式，更新换代如此之快，又何来时间去真正研发款式，把握产品质量呢？那么大量款式抄袭，不顾质量如何也成了理所当然。殊不知，这种不负责任的行为在应付消费者的同时，也为自己的企业将来埋下重大隐患。

 
 

笔者在此提醒，生产和销售不合格产品不仅要被没收违法所得，还要被额外处罚，严重的甚至有可能被追究刑事责任。衣食住行乃人类生存之根本，我们之所以选择品牌，是因为我们信任品牌，如果品牌连最基本的质量都不能有所保障的话，这无异于自杀行为。这一次，H&M失去的不仅是消费者，还有自己企业的前途。莫因一时之利，而毁长久之计。
