Under what circumstances would a human trafficker be sentenced to death like Yu Huaying?

On February 28, 2025, the highly publicized 'Human Trafficker Yu Huaying Case' finally reached its final verdict. With approval from the Supreme People's Court, Yu Huaying was sentenced to death for committing multiple serious crimes, including child trafficking and unlawful detention. This verdict not only demonstrates the law's zero tolerance for human traffickers, but also delivers delayed justice to the victims and their families. So, under what circumstances would a human trafficker be sentenced to death like Yu Huaying?

First of all, we must make it clear that sentencing human traffickers to death is not something taken lightly. Our country's law has always adhered to the principle of 'less killing, cautious killing' in death penalty cases, and the death penalty is only considered when the crime is particularly serious and has an extremely negative impact on society. Regarding the crime of child trafficking, according to Article 240 of the Criminal Law of the People's Republic of China, human traffickers can only be sentenced to death under certain specific circumstances.

These specific situations include but are not limited to:

　The leading member of the child trafficking group:The primary figure who plays an organizing and leading role in the criminal activities of child trafficking, and serves as a key figure for the entire criminal group.

　Trafficking of three or more children:The number of children trafficked by human traffickers reaching three or more shows the widespread and serious nature of their criminal behavior.

　For the purpose of selling, using violence, coercion, or anesthesia to kidnap children:Human traffickers kidnap children for the purpose of trafficking by using violence, coercion, or sedatives. Stealing infants and young children with the intent to sell them:Human traffickers secretly steal infants and young children for the purpose of selling them. This criminal behavior is extremely heinous, not only infringing on the legal rights of the infants and young children but also violating the moral bottom line of society.

Causing serious injury, death, or other serious consequences to children who have been trafficked or their relatives:The criminal acts of human traffickers result in kidnapped children or their relatives suffering serious injury, death, or other severe consequences, and the severity of these criminal outcomes makes the death penalty a possible sentence.

Selling children abroad:Human traffickers sell children abroad, which not only violates the children's human rights but also harms the country's image and interests. This kind of cross-border criminal activity is often accompanied by even more serious consequences.

In the case of Yu Huaying, since 2015, she has been engaged in criminal activities of child trafficking in multiple provinces. Taking advantage of the lack of information and weak preventive awareness in rural areas, she used means such as luring and coercion to consecutively abduct multiple children and sell them to remote areas. According to police investigations, during her 8-year criminal career, Yu Huaying was involved in more than 20 child trafficking cases, with the youngest victim being only 2 years old. Such widespread criminal behavior and severe criminal consequences led to Yu Huaying ultimately being sentenced to death.

In addition to the above situations, human traffickers may also commit other crimes during the process of trafficking children, such as illegal detention or intentional injury. The accumulation of these charges can also increase their criminal liability, thereby increasing the possibility of being sentenced to death.

However, we must also be clear that the death penalty is not the only means to address the problem of child trafficking.
